Patent Bar Prep - Day 30 February 4, 2007

Today, I finished Chapter 16 (~50Qs) and 17 (~20Qs). With 17 under my belt, I can finally do that “10… 9… 8… 7…” countdown to Chapter 27.

Chapter 16 (Inventorship) is about as easy as the Patent Bar gets. Basically all you have to remember is that if someone doesn’t contribute to the conception of an invention, they are not an inventor. Everything else in the chapter is just an extension of that basic rule. Man, this stuff is such a freebie. I hope I have a ton of questions on this on my exam.

Chapter 17 (Patent Term) on the other was unexpectedly brutal. Generally, a patent term starts from the date of issuance to 20 years from the original filing date. But, with all the rules related to Patent Term Adjustments due to secrecy orders, delayed IDS filings, interferences, successful (or unsuccessful) appeals, etc., it gets fairly complex. The AIPA doesn’t help in making things simpler. Luckily patent term adjustments do not seem to be heavily tested on the exam so I should be okay.

Anyway, that’s about it for today. Gotta go home and read for Corporations. I still haven’t been called on in that class so I am pretty sure it is about to happen.

Chapter 15 was an interesting ride. After getting an alarming number of questions wrong, I decided to go back to the lecture videos and refresh my memory. A couple hours later, when I picked up where I had left off, I did considerably better. Finally finished all 200 of these painful questions. Man… 15 down 12 more to go. Tomorrow I will start on 16.

Finished Chapter 14. It wasnt too bad. I think it had about 60 questions. Then I started on Chapter 15 which is all about Replies, Office Actions, Certificates of Mailing etc. This chapter is a monster because it has about 200 practice questions. I am only on Q35. At this point, I am not spending too much time thinking and diagramming these things. I read it… try and and articulate why I am picking or elminating an answer choice, and then choose the best answer. Not the best way to do this but it’s getting late in the semester and things are ramping up quickly. I have already been called on in my UCC class so I am sure I will be called on in both the other classes too. So, my attitude about the Patent Bar right now is to just take it and see how it goes. If it doesn’t happen, I could just take it over the summer.
