Patent Bar Prep - Day 06 December 23, 2006

I picked up on the videos where I left off and got through the ones covering 35 USC 102 (b) through (e) and some parts of PCT (35 USC 351). They keep bringing up PCT but tell the viewer to ignore it for now. (Annoying!)

My initial impression of section 102 was that it was fairly straightforward stuff but it has gotten complex very quickly and I haven’t even reached the part on interferences yet. I haven’t figured out how to keep the nuances between the sections clear in my mind yet. I am hoping the questions will help with that.

Also, I still haven’t done any more practice questions (I left off at Q74 for Chapter 3 I think). I am trying to get through the videos on this entire section before I resume that. There are about 2 or 3 more hours of lectures on this stuff.

Patent Bar Prep - Day 05 December 21, 2006

I had to restart video 4 because I was pretty tired last night when I viewed it. So, I went over Novelty (35 USC 102) from the beginning.

I started with Novelty and Loss of Right to Patent and covered concepts related to the date of invention (Conception, Actual/Constructive Reduction to Practice and how Diligence can come into play). After that I focused on 35 USC 102(a). It had a lot more nuances than I thought it would.

I remembered the basics from my Patent Prosecution class but we did not cover how 35 USC 104 affects the date of invention for foreign (e.g. NAFTA and WTO countries). I am trying to boil it down to two milestone dates (December 8, 1993 and January 1, 1996) and attempting to memorize it. I don’t like the fact that I have to memorize this type of stuff but oh well… sometimes, you just have to eat it and pretend you like it.

I didn’t do any questions today at all mostly because of two distractions. First, I took out a couple of hours to go to my Yoga class. I know it sounds “new age” but it helps with getting my post-exam body (carcass) moving again. I am going to try and go every day because I feel a lot better after it. And, these last three hours of studying (after the yoga class) were a lot more productive. The other distraction that is really throwing me off track is my new-found addiction to House. I have the next DVD at home and am itching to go see it.

Net Result: I am still behind on the chapter on claims. Hopefully, I can make up for lost time over the weekend. I still have about 2 weeks to go before school starts again. If I can get through the material once, I will be in good shape to get this done early in the year.
